SHORT TITLE: Relating to qualifications of members of certain county commissions.

CODE SECTIONS AFFECTED: Amends §7-14-3, §8-14-7 and §8-15-12
CHAIRMAN’S SUMMARY: This bill adopts the following additional standards for individuals appointed commissioners of the Policemen’s Civil Service Commission, the Firemen’s Civil Service Commission and the civil service commissions of the counties:
1) They may not be a relative of any person appointing him or her to that commission, as relative is defined in West Virginia Code §6B-1-3. (That section defines “relative” as a “spouse, mother, father, sister, brother, son, daughter, grandmother, grandfather, grandchild, mother-in-law, father-in law, sister-in-law, brother-in-law, son-in-law or daughter-in-law).
2) They may not have been convicted of a felony or any misdemeanor involving moral turpitude; and
3) They must reside in the counties where they serve and be a qualified voter of the county.
MEMO ON THE AMENDMENT OF THE COMMITTEE ON POLITICAL SUBDIVISIONS.
The Committee on Political Subdivision’s amendment did extensive rearranging of a number of provisions throughout the bill, and did minor cleanup and technical changes, but made no substantive change to the proposed provisions of the bill.
The Staff Recommended Committee Substitute incorporates the suggested amendments of the Committee on Political Subdivisions, with a minor title change.
